Device Skyroam Hotspot Device Pick-Up Date The date the Device is available for pick-up by the Client at the Pick-Up Place during the hours of 8am u2013 5pm, as indicated in the Rental Agreement. The Pick-Up Date shall not be more than 24 hours from the date of departure of the Client from the Philippines. Return Date The date the Client is required to return the Device at the Pick-Up Place during the hours of 8am u2013 5pm, as indicated in the Rental Agreement. The Return Date shall not be more than 24 hours from the date of arrival of the Client from the Philippines. Client Individual(s) who leased the Skyroam Hotspot Device from the Company. Terms These General Terms and Conditions for the lease of Skyroam Hotspot Device. Rental Term Rental Period for the lease of the Skyroam Hotspot Device beginning on the Pick-Up Date and ending on the Return Date. Service Period The period the Client may access internet data thru the Device in the available jurisdictions beginning the day the Client departs the Philippines and ends on the day he arrives the Philippines, as indicated in the Clientu2019s confirmed ticket. Day P A 24-hour period beginning 08:00 am and ending 07:59 am the following day Philippine Standard Time, and allows the Device to data at a maximum of 3.5G speed of the country where it will be used up to a maximum of one gigabytes (1GB). A speed of 2G then applies for data after the gigabytes (1GB) limit. Rental Charges The fee payable to the Company for the lease of the Skyroam Hotspot Device during the Service Period. Deposit A refundable amount payable to the Company to guarantee the return of the Device and its accessories on the Return Date and in good condition. In case the Client fails to return the Device or any of its accessories or returned damaged, the Deposit shall be forfeited by the Company. Penalty Fees Additional payment due to the Company in case of the late return of the Device equivalent to double the cost of a Day P and commencing the day after the Return Date. Article 2. Rental of Device Subject to the payment by the Client of the Rental Charges and Deposit, and the due execution of the Rental Agreement, the Company shall ensure that the Device is available to the Client on the Pick-Up Date. The Client shall pick-up the Device at any time during the Pick-Up Date at the Pick-Up Place. The rental of the Device shall cover at least the Service Period. The Companyu2019s authorized representative shall instruct the Client on the proper use, handling and care of the Device. In case the Client foresees a delay in returning the Device on the Return Date, he/she should immediately inform Skyroamu2019s authorized representative. Penalty fees may apply. Only reservations confirmed by the Company will be honored. Reservations without payment will not be accepted. Cancellations without penalty may be accepted provided it is made before the Pick-Up Date. In case the Client fails to pick up the Device on the Pick-Up Date or cancels the reservation during the Pick-Date, the Company shall forfeit the Rental Charges paid. Upon its return, the Device will be inspected by the Companyu2019s representative to verify that it has been returned in good condition. Article 3. Charges The Client shall pay the Company the Rental Charges equivalent to the number of Day P es required to avail of internet data thru the Device during the Service Period. Should the Client fail to return the Device on the Return Date, the Client shall pay the Company double the cost of a Day P for each day of delay beginning the day after the Return Date. If the Client fails to return the Device for more than 24 hours from the Return Date, the Company shall forfeit the Security Deposit. Should the Client fail to return or damage the Device or its accessory, the cost of replacement shall be deducted from the Security Deposit: Skyroam Unit Damage (P4,000) USB Cable (P300) Skyroam Box/Case (P500) Article 4. Internet Service Availability The rental of the Device authorizes the Client to access internet data thru the Device in the jurisdictions specified in the annex hereto and during the Service Period. The Client shall use the Device in accordance with this Agreement, the laws, rules and regulations of the jurisdiction and those of the internet service provider. Availability of internet data in the jurisdictions during the Clientu2019s dates of visit is dependent on the service of the Internet Service Provider of that jurisdiction. The Client hereby acknowledges that the Company cannot ensure availability of internet data in the identified jurisdictions during the Clientu2019s visit. The Client shall not use the Device or allow its use for any illegal activities. The Device shall not be used in the Philippines. Article 5. Technical Problems In case of technical problems, the Client must reach Skyroamu2019s Customer Support website (www.bigskynation.com/contact-us) or call at (+632)8857626/(+632)4031399 or (+63)09189647626. The Client must not attempt to repair the device. The Device must not be dismantled. If proven to be dismantled or repaired, the Device shall be treated as damaged and the Security Deposit will be forfeited. Article 6. No Liability to Client The Client acknowledges that (a) the Device may be damaged as a result of handling and transport, and that (b) internet service in the countries where the Device may be utilized may be interrupted due to various causes, including but not limited to, force majeure, acts of God, power and system failure, acts or omissions of third parties.
